Bimmy’s, a sandwich wholesaler owned by Elliot Fread, has been accused of several counts of wage violations.
The slogan for gourmet sandwich maker Bimmy’s is Food made with love. ” But two former employees for the Long Island City, Queens-based wholesaler allege they received less love, and less money, than they were due.
Aurelio Ramalez and Maria Tenezela, who worked at Bimmy’s for five and two years, respectively, have accused Bimmy’s and owner Elliot Fread of several counts of wage violations. The workers allege that they were not paid full minimum wage during some work weeks, that they were not paid time-and-a-half for overtime, and that they did not receive the statutory compensation for care and maintenance of uniforms each week, which typically costs between $6 and $10 per worker.
We’re hoping to recover unpaid wages on behalf of our clients as well as the class action workers they represent, ” said Rachel Bien, the Outten & Golden attorney representing the plaintiffs in the case. She explained that more than 100 workers could be affected by the lawsuit. Make the Road New York, the community-based nonprofit that helps workers recover wages, estimates the costs involved with this case are in the hundreds of thousands of dollars.
