BLACK MOUNTAIN A Tennessee employee of regional grocery chain Ingles Markets is seeking class-action status for his lawsuit claiming the company did not pay him required premium wages for working overtime.

The suit was filed Tuesday in U.S. District Court for the Eastern District of Tennessee by Nathan Gilliard of Madisonville, Tenn.

Federal law requires that employers pay workers one and a half times their normal hourly wage for any hours they work exceeding 40 in a given week. The requirement does not apply to some management workers, but the suit says Gilliard is not exempt.

Ron Freeman, Ingles’ chief financial officer, declined comment.
